FULL TERMS AND CONDITIONS

These are the terms and conditions (“Terms”) that apply to the Constellation Automotive Group Staff Discount Promotion (the “Promotion”). The Promotion is open for purchases made from 13th November 2020 through to the dates set out in the table below (the “Promotion Period”). The Promotion entitles staff members of BCA Marketplace Limited and its subsidiaries, cinch, elmo and Marshall Motor Group to a £250 discount off the purchase of a car on cinch.co.uk.

* Claims must be made within 60 days of purchase.

1. The Promoter

   The Promoter is Cinch Cars Limited, with its registered office at Form 2, 18 Bartley Wood Business Park, Bartley Way, Hook, Hampshire, RG27 9XA. VAT number 360909784.

2. Eligibility for discount

   To be eligible for the Promotion you must:

   1. be employed by BCA Marketplace Limited and its subsidiaries, cinch, elmo or Marshall Motor Group;
   2. be over 18 years old and resident in the UK with a working email address; and
   3. have received a single-use unique discount code from your employer which you will need to request from peopleteam@bca.com. If you work at Marshall Motor Group, please email colleague.benefits@marshall.co.uk.

   If you have not received an official email or internal communication regarding the discount, then you are most likely not eligible to participate. Please speak directly with your employer to understand whether or not you are eligible.

   Each employee is eligible for 10 unique single-use discount codes. Only one code can be used per qualifying purchase.

   The discount cannot be used in conjunction with any other employee discounts or offers (not including any site-wide offers that apply to all users of cinch.co.uk).

3. Transferring the discount to family

   You may give your discount to family members or friends, but each unique code is single-use and may not be used more than once. Only one code can be used per qualifying purchase.

   If you would like to transfer your discount to a member of your family, they will need to visit www.cinchstaffdiscount.co.uk after they make a qualifying purchase of a car from cinch.co.uk and follow the steps indicated, entering the unique code, their valid order number, and your name and address and other required details.

   The purchaser must also be over 18 years old and be a resident in the UK with a working email address.

4. How to claim the discount

   The discount can only be claimed on cars purchased directly from cinch through cinch.co.uk during the Promotion Period.

   The discount can only be claimed post purchase; and after the 14-day cancellation period has expired; and without the purchase having been cancelled or the car being returned for any reason.

   Steps to claim the £250 discount:

   1. Request the single-use unique code and details of the discount from peopleteam@bca.com. If you work at Marshall Motor Group, please email colleague.benefits@marshall.co.uk;
   2. visit cinch.co.uk and purchase a car from cinch (for home delivery or collection) during the Promotion Period;
   3. keep the car past the 14 day cancellation period. (Also, the purchase must not have been cancelled not the car returned at any time before verification of the claim; and
   4. visit www.cinchstaffdiscount.co.uk within 60 days of your purchase to claim the discount, following the steps indicated and entering all required information including your unique code, order number, bank details, and name and address of eligible employee.
   5. The discount of £250 will only be paid if you follow all the above steps. Claims must be made within 60 days of date of purchase. No claim will be processed until validated. The bank transfer of the £250 discount may take up to 35 days from the date on which you provide all required information.

5. Limitation of liability

   As far as is permitted by law, the Promoter, your employer, or their agents or employees will not be responsible or liable to compensate you or accept any liability for any loss or damage occurring as a result of participating in the Promotion. This does not exclude any liability for fraud, death or personal injury or other liability that may not be excluded by law. Your statutory rights are not affected.

   Any tax, National Insurance, bank charges or other liability, cost or expense connected with claiming or receiving the discount is exclusively the responsibility of the participant.

   The Promoter takes no responsibility for claims that are delayed, incomplete or lost due to technical reasons, network or server issues, or otherwise.

   It is the responsibility of the participant to provide their correct, up-to-date details when claiming the discount. The Promoter cannot be held responsible for participants failing to supply accurate information which affects verification or delivery of the discount.

   Whilst the Promoter will take all reasonable steps to ensure that its obligations in relation to running of the Promotion and dispatching of payments are met, the Promoter shall not be liable in any way for its inability to meet these timeframes resulting from its own business or its supply chain (including third party processors) being affected by Covid-19 infections or related restrictions, or for any other reason outside the Promoter’s reasonable control.

   Should Covid-19 infections or related restrictions affect the Promoter’s ability to meet any of its obligations, the Promoter reserves the right to extend the Closing Date and/or any other deadlines and/or make any other necessary modifications to the Promotion but will use reasonable endeavours to resume the Promotion and fulfil its obligations as soon as is reasonably possible after its and/or its third party processors resume business as usual.

6. Terms and Data Protection

   These Terms do not affect the terms of purchase of the relevant vehicle set out at https://www.cinch.co.uk/terms-and-conditions.

7. General

   The discount is non-transferable except as set out in these Terms and non-exchangeable for any other benefit. It must be claimed and paid in accordance with these Terms and no compensation will be payable if you do not claim the discount within 60 days from the date of purchase.

   The Promoter’s decision in relation to claims is final and binding. Making a discount claim implies acceptance of these Terms.

   Instructions provided at the point of discount claim form part of the Terms of this Promotion. In the event of a conflict, these Terms take precedence. Please retain a copy for your information.

   The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any claims or participants that it regards as being in breach of these Terms. Those who try and circumvent the claim process and/or instructions will be disqualified and any discount claimed will be void.

   The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any participants or third parties but will use all reasonable endeavours to replace or resume this promotion where possible.

   If any clause or provision of these Terms is declared by a court to be illegal, invalid or unenforceable, this declaration shall not affect the validity and enforceability of any other clause or provision within.

   The application and interpretation of these Terms shall be governed by the law of England and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.
